The Government of the Falkland Islands

The Falkland Islands are a self-governing British Overseas Territory under a constitutional monarchy. While the King is the head of state, executive authority is exercised on his behalf by an appointed Governor. All domestic affairs are governed locally, while the UK is responsible for defence and foreign policy.

The Non-Ministerial System

Unlike many parliamentary democracies, the Falklands do not have government ministers.

How it Works

Each MLA is assigned a portfolio and works with civil servants to manage specific areas of government.

Collective decision-making

All major executive decisions are made in Executive Council.

No official opposition

All MLAs are independent, focusing on representing their constituents rather than political parties.

Limitations

MLAs cannot directly command FIG officers except through decisions approved in Executive Council.

The Three Branches of Government

The Legislature

The Legislative Assembly is the Falklands’ law-making body. It is responsible for creating laws, setting policies, and approving budgets.

Members: 8 elected MLAs (5 from Stanley, 3 from Camp).

Ex-officio members: Chief Executive & Financial Secretary (non-voting).

Other attendees: Commander of British Forces South Atlantic Islands (BFSAI) and the Attorney General.

Meetings: Usually held monthly, on the last Thursday of each month.

Chair: The Speaker of the House, chosen by the Assembly after each election

The Executive

The Executive Branch includes the full civil service, led by the Chief Executive, and the Executive Council, the main decision-making body.

Executive Council: Chaired by the Governor, with most decisions made by the elected MLAs.

Role of MLAs: Work with civil servants to oversee specific areas such as education, health, and island security.

The Judiciary

The Judiciary operates independently to ensure laws are enforced fairly and impartially.

The proposed salmon farming operation from Unity Marine is an example of why we must balance opportunity with environmental responsibility. The last Assembly’s decision to not hold a public consultation was well-intentioned but ultimately only served to delay the process that will be required before a decision can be taken. The consultation process will take place early next year and it will then be down to the next Assembly to resolve this issue. As with any decision an MLA takes, I will always consider the full array of information presented to me, including any information gathered from the consultation. However, I don’t believe anything that has been presented on the subject during the debate over the last few years has shown that it is the right path for the Falkland Islands.
