The Falkland Islands Government

The Falkland Islands are a self-governing British Overseas Territory under a constitutional monarchy. While the King is the head of state, executive authority is exercised on his behalf by an appointed Governor. All domestic affairs are governed locally, while the UK is responsible for defence and foreign policy.

The Non-Ministerial System
Unlike many parliamentary democracies, the Falklands do not have government ministers.
How it works
Each MLA is assigned a specific portfolio and works alongside civil servants to manage that area of government.
Collective decision-making
Major executive decisions are made collectively by the Executive Council, ensuring accountability and collaboration across government.
No official opposition
All MLAs are independent, focusing on representing their constituents rather than political parties.
Limitations
MLAs cannot directly instruct government officers except through decisions approved by Executive Council.

The Three Branches of Government

The Legislature

The Legislative Assembly is the Falklands’ law-making body. It is responsible for creating laws, setting policies, and approving budgets.

Members: 8 elected MLAs (5 from Stanley, 3 from Camp).

Ex-officio members: Chief Executive & Financial Secretary (non-voting).

Other attendees: Commander of British Forces South Atlantic Islands (BFSAI) and the Attorney General.

Meetings are usually held monthly, on the last Thursday of each month and are chaired by The Speaker of the House, chosen by the Assembly after each election.

The Executive

The Executive is responsible for implementing laws and delivering public services in the Falkland Islands. It manages day-to-day government operations and ensures policies agreed by the Legislative Assembly are carried out.

The Executive is led by the Chief Executive and supported by Government Directors who oversee areas such as health, education, finance, and natural resources.

Puts legislation and policies into action. Manages government departments and public services. Develops strategies, budgets, and long-term plans. Works with the Legislative Assembly to deliver priorities for the community.

The Judiciary

The Judiciary operates independently to ensure laws are applied fairly and impartially. It interprets legislation, resolves disputes, and reviews the lawfulness of decisions made by public bodies.

Includes the Summary Court, Magistrates’ Court, Supreme Court (with unlimited jurisdiction) and Court of Appeal. Higher courts are usually presided over by visiting UK judges to ensure independence.

Hears criminal, civil, and family matters. Handles appeals and upholds the Constitution. Acts as an essential check on the Executive and Legislature through judicial review.
